These terms govern your use of Birthday Ping (the "Service"), a birthday tracking app with countdowns, reminders and AI-generated gift ideas. The Service is provided by Birthday Circle Media, based in Ireland ("we", "us"). When you use the Service, you are contracting with Birthday Circle Media.

1. Acceptance

By creating an account or continuing to use the Service, you agree to these terms. If you do not agree, please do not use the Service.

2. Eligibility and your account

You must be of legal age in your country, or have authority to bind the organisation you represent. You must give accurate information, keep your login details confidential, and you are responsible for activity under your account.

3. Plans

The Free plan includes one circle and up to five people. The Pro plan (€3.99 per month or €29 per year) removes these limits and adds extra features such as email reminders. We grant you a limited, non-exclusive, non-transferable right to use the Service within your plan.

4. Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, taxes, renewals, cancellations and refunds are governed by Paddle's Buyer Terms. Subscriptions renew automatically until cancelled. If you cancel, Pro stays active until the end of your paid period.

5. Acceptable use

You must not misuse the Service, including:

• using it for anything unlawful, fraudulent or for spam;
• infringing anyone's intellectual property or privacy;
• uploading malware, probing or attacking our systems, or scraping the Service;
• reverse engineering, reselling, or getting around plan limits.

6. AI gift ideas

Gift ideas are generated by AI from the age and interests you enter. They may be inaccurate, unsuitable or unavailable, and prices are estimates. You are responsible for what you enter and for checking any suggestion before you rely on it. We may filter or refuse outputs.

7. Your content

You keep ownership of the names, dates and interests you add. You give us a limited licence to store and process them only to provide the Service. Only add information about other people where you have a reasonable basis to do so.

8. Our intellectual property

Birthday Circle Media owns the Service, including its software, design, documentation and branding.

9. Service availability

We work to keep the Service running, but we do not guarantee it will be uninterrupted or error-free. To the fullest extent allowed by law, the Service is provided "as is" without implied warranties.

10. Suspension and termination

We may suspend or end your access for a material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You can delete your account at any time. When access ends, we delete your data within a reasonable time unless the law requires us to keep it.

11. Liability

We are not liable for indirect or consequential losses, such as lost profits or data, or a missed birthday. Our total liability is limited to the fees you paid us in the previous 12 months. Nothing here limits liability for fraud, death or personal injury caused by negligence, or anything else that cannot be limited by law.

12. Changes

We may update these terms. If changes are significant, we will tell you in the app or by email.

13. Governing law

These terms are governed by the laws of Ireland, and disputes go to the Irish courts. This does not remove any mandatory consumer rights you have where you live.
